CourtUp.ca Sports Event Registration Platform

Please read these Terms of Service carefully before using CourtUp.ca. By creating an account, joining an organization, or registering for any event on this platform, you agree to be legally bound by these Terms. If you do not agree, please do not use the platform.

Event fees are charged to your membership balance. Refunds follow the organization's policy.

You are responsible for the safety and accuracy of information you provide and activities you participate in.

These Terms are governed by the laws of Canada and the province in which we operate.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and CourtUp.ca ("CourtUp.ca", "we", "us", or "our"), a corporation incorporated under the laws of Canada, governing your access to and use of the CourtUp.ca platform, including its website, mobile-optimized interface, and all related services (collectively, the "Platform").

By accessing or using the Platform in any manner — including, without limitation, by creating an account, joining an organization, registering for an event, or browsing the calendar — you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Definitions

For the purposes of these Terms, the following definitions apply:

Term Meaning
"Platform" The CourtUp.ca website, software, and all related services operated by CourtUp.ca
"User" Any individual who accesses the Platform, whether or not they have created an account.
"Account" A registered user profile created on the Platform with a unique email address and credentials.
"Organization" A sports club, league, association, or group that registers on the Platform to manage events and members.
"Org Admin" A User with administrative authority over an Organization on the Platform.
"Event" A scheduled sports session, game, tournament, clinic, or activity created by an Organization on the Platform.
"Registration" The process by which a User enrolls in an Event, resulting in a confirmed or waitlisted status.
"Membership" The relationship between a User and an Organization on the Platform, including associated balance, role, and status.
"Membership Balance" A prepaid or credited monetary amount held within a Membership record and used to pay for Event Registrations.
"Content" Any text, images, data, or other material submitted to, or displayed on, the Platform by any User or Organization.
"PIPEDA" The Personal Information Protection and Electronic Documents Act, S.C. 2000, c. 5, as amended from time to time.

3. Eligibility

3.1 Age Requirement

You must be at least 13 years of age to create an Account or use the Platform. If you are between 13 and 18 years of age, you may only use the Platform with the express prior consent of a parent or legal guardian who agrees to these Terms on your behalf. By using the Platform, you represent and warrant that you meet this age requirement.

3.2 Legal Capacity

You represent that you have the legal capacity to enter into a binding agreement. If you are using the Platform on behalf of an Organization, you represent that you have the authority to bind such Organization to these Terms.

4. User Accounts

4.1 Account Registration

To access most features of the Platform, you must register for an Account. You agree to provide accurate, current, and complete information during registration and to keep that information up to date. Each Account is personal and non-transferable.

4.2 Email Verification

After registration, CourtUp.ca will send a verification email to the address you provide. Your Account will remain in an unverified state until you complete email verification. Verification links expire after 24 hours. You may request a new link if yours has expired.

4.3 Account Security

You are solely responsible for maintaining the confidentiality of your Account credentials. You agree to notify us immediately at support@courtup.ca if you suspect any unauthorized access to or use of your Account. CourtUp.ca will not be liable for any loss or damage arising from your failure to safeguard your credentials.

4.4 Password Requirements

Passwords must be a minimum of eight (8) characters and contain at least one number and one special character. CourtUp.ca may enforce additional password policies at its discretion.

4.5 Third-Party Authentication

You may also register or sign in using a supported third-party OAuth provider (such as Google, Facebook, or WeChat). When you do so, you authorize CourtUp.ca to collect and use the information provided by that provider in accordance with our Privacy Policy. Your use of such providers is subject to their own terms of service.

5. Permitted Platform Use

5.1 Permitted Uses

Subject to these Terms, CourtUp.ca grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for the following purposes:

  • Browsing and discovering sports events in your area;
  • Creating and managing a personal Account and profile;
  • Joining and participating in Organizations;
  • Registering for and attending Events; and
  • If you hold an administrative role, managing an Organization, its Playgrounds, Events, and Members.
5.2 Prohibited Uses

You agree that you will not:

  • Use the Platform for any unlawful, fraudulent, or harmful purpose;
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  • Attempt to circumvent any security feature, authentication measure, or access control;
  • Use automated tools (bots, scrapers, crawlers) to access the Platform without our prior written consent;
  • Introduce viruses, malware, or other malicious code;
  • Collect, harvest, or store personal information about other Users without their consent;
  • Interfere with or disrupt the integrity or performance of the Platform or its infrastructure;
  • Reproduce, copy, sell, or exploit any portion of the Platform without our express written permission;
  • Register for Events under false pretences or with the intention of disrupting Events; or
  • Use the Platform to harass, threaten, or defame any individual or group.

6. Event Registrations & Waitlists

6.1 Membership Requirement

To register for an Event, you must be an approved Member of the Organization that hosts that Event. Membership requests are subject to approval by the Organization's administrators.

6.2 Registration Window

Each Event has a defined registration open date and registration close date. You may only register for an Event during this window. CourtUp.ca is not responsible for any Event for which you failed to register during the applicable registration window.

6.3 Capacity & Waitlists

Events have a maximum player capacity set by the Organization. If an Event is full at the time of your registration, you will be automatically placed on a waitlist. When a registered participant cancels their registration, the first person on the waitlist is automatically promoted to registered status and the applicable event fee is charged to their Membership Balance.

6.4 Cancellations & Unregistration

You may cancel your registration for an Event at any time before the Event has started. You cannot cancel a registration after an Event has commenced. Upon a permitted cancellation:

  • If you held a REGISTERED status, the event fee will be refunded to your Membership Balance.
  • If you held a WAITLIST status, no charge applies and no refund is issued.
  • The next person on the waitlist (if any) will be automatically promoted.
6.5 Administrative Cancellations

Organization administrators may cancel any registration on your behalf, including in cases of policy violations, safety concerns, or at the request of the organization. If an administrator cancels a REGISTERED entry, any applicable refund will be issued to your Membership Balance in accordance with the organization's refund policy.

6.6 Free Event Policy

To ensure equitable access, a User may only register for one (1) free event (an event with a member cost of $0.00) per organization per calendar day. Attempts to circumvent this policy may result in administrative cancellation of duplicate registrations.

7. Payments, Balances & Refunds

7.1 Membership Balance

The Platform uses a prepaid Membership Balance system. Your Balance is associated with each individual Membership (one per Organization) and is credited by your Organization's administrators via deposits or adjustments. CourtUp.ca does not directly collect funds from Users; payment arrangements are made between you and the Organization.

7.2 Event Charges

When you register for a paid Event, the applicable member cost is immediately deducted from your Membership Balance. If your Balance is insufficient, you may be unable to complete registration. CourtUp.ca does not extend credit.

7.3 Transaction Records

A record of every financial transaction (CHARGE, REFUND, DEPOSIT, ADJUSTMENT) is maintained within your Account and accessible on the My Transactions page. You are responsible for reviewing these records and notifying your Organization or CourtUp.ca of any discrepancies within thirty (30) days of the transaction date.

7.4 Refunds

Refunds of event fees are issued to your Membership Balance, not to any external payment method. The timing and conditions of refunds are governed by Section 6.4 (Cancellations). Refunds of Balance deposits (i.e., cash refunds from the Organization) are subject solely to the individual Organization's policies and are outside CourtUp.ca's control.

7.5 Taxes

All fees are stated exclusive of applicable Canadian federal or provincial taxes (including GST/HST/PST where applicable). Tax obligations, if any, will be addressed by the relevant Organization in accordance with applicable Canadian tax law.

Important: CourtUp.ca is a platform intermediary. CourtUp.ca is not a party to any financial transaction between you and an Organization. CourtUp.ca does not hold, process, or transmit funds on your behalf.

8. Organizations

8.1 Organization Registration & Approval

Any registered User may apply to create an Organization on the Platform. All new Organizations are subject to review and approval by CourtUp.ca's site administrators before becoming visible to the public. CourtUp.ca reserves the right to refuse or revoke approval of any Organization at any time, without prior notice, if we determine that the Organization violates these Terms or is not in the best interests of the Platform or its community.

8.2 Organization Responsibilities

The Organization and its administrators are solely responsible for:

  • The accuracy of all Event information including dates, times, locations, costs, and player limits;
  • Compliance with all applicable local, provincial, and federal laws, including those related to sport, health and safety, and data protection;
  • Ensuring Events are conducted in a safe, fair, and inclusive manner;
  • Communicating cancellations, changes, or other material updates to registered participants promptly;
  • Managing Membership Balances, deposits, and adjustments fairly and transparently; and
  • Obtaining all necessary permits, insurance, and authorizations for Events held at physical venues.
8.3 Organization Content

Organizations are responsible for all Content they post on the Platform, including organization descriptions, event details, and logos. By submitting Content, Organizations grant CourtUp.ca a worldwide, royalty-free, non-exclusive licence to display, reproduce, and transmit such Content solely for the purpose of operating the Platform.

8.4 Org Admin Authority

Org Admins have the authority to approve or reject membership requests, promote or demote members, cancel registrations, adjust Membership Balances, and remove members. All such administrative actions must be exercised in good faith and in compliance with these Terms and applicable law.

9. User Conduct & Community Standards

9.1 Respect & Sportsmanship

CourtUp.ca is committed to fostering a respectful, inclusive, and sportsmanlike community. All Users and Organizations must treat fellow participants, administrators, and CourtUp.ca staff with courtesy and respect, both on and off the Platform.

9.2 Prohibited Behaviour

You agree not to engage in any of the following while using the Platform or attending Events:

  • Harassment, bullying, intimidation, or discrimination based on race, national or ethnic origin, colour, religion, sex, sexual orientation, gender identity, age, disability, or any other protected ground under the Canadian Human Rights Act;
  • Violent, abusive, or threatening conduct towards any person;
  • Fraudulent registration (registering for an Event on behalf of another person without their knowledge, or using false identity information);
  • Deliberate disruption of Events or the Platform's operations; or
  • Any conduct that is illegal under applicable Canadian federal or provincial law.
9.3 Physical Participation & Safety

Sports activities carry inherent physical risks. By registering for and attending Events, you acknowledge these risks and confirm that you are physically fit and medically able to participate. You agree to follow all safety instructions and rules communicated by the Organization, venue operators, and Event officials.

9.4 Reporting

If you witness or experience conduct that violates these standards, you are encouraged to report it to the Organization's administrators or to CourtUp.ca at su****t@c******.ca. CourtUp.ca will review all reports and may take appropriate action, including Account suspension.

10. Privacy & Personal Information

10.1 Collection & Use

CourtUp.ca collects, uses, and discloses personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, provincial privacy legislation such as the Personal Information Protection Act (PIPA, BC and Alberta) and Loi sur la protection des renseignements personnels dans le secteur privé (Quebec Law 25). Our full Privacy Policy, available at /privacy-policy.html, describes in detail what information we collect, why we collect it, and how it is used.

10.2 Personal Information You Provide

When you create an Account, you provide personal information including your name, username, email address, and password. When you create or update a profile, you may optionally provide a biography, avatar, and sports ratings (DUPR, GNPN). This information is used to operate the Platform and facilitate your participation in Events.

10.3 Sharing with Organizations

By joining an Organization, you consent to that Organization's administrators viewing your name, username, email address, profile information, Membership Balance, and registration history within the scope of that Organization. CourtUp.ca does not sell personal information to third parties.

10.4 Your Rights

You have the right to access, correct, or request deletion of your personal information held by CourtUp.ca, subject to our legal obligations. Requests may be submitted to pr****y@c******.ca. We will respond within thirty (30) days in accordance with PIPEDA.

11. Intellectual Property

11.1 CourtUp.ca's Property

All rights, title, and interest in and to the Platform, including its design, software, code, trademarks, logos, trade names, and original Content created by CourtUp.ca, are owned by CourtUp.ca or its licensors and are protected by Canadian and international intellectual property laws. You are granted only the limited licence described in Section 5.1 and no broader rights.

11.2 User-Submitted Content

You retain ownership of any Content you submit to the Platform (such as profile information or organization logos). By submitting Content, you grant CourtUp.ca a non-exclusive, worldwide, royalty-free licence to use, store, display, and reproduce such Content solely to operate and improve the Platform. You represent and warrant that you have all rights necessary to grant this licence.

11.3 Feedback

If you provide CourtUp.ca with suggestions, feedback, or ideas regarding the Platform, you agree that CourtUp.ca may use such feedback without compensation or attribution to you.

12. Disclaimers & Warranties

12.1 "As Is" Basis

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE CANADIAN LAW.

12.2 No Guarantee of Availability

CourtUp.ca does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We may temporarily suspend or modify the Platform for maintenance or other reasons without notice.

12.3 Organization and Event Disclaimer

CourtUp.ca is a technology platform only. We do not organize, operate, supervise, or control any Event or Organization. CourtUp.ca makes no representations or warranties regarding:

  • The accuracy of Event information provided by Organizations;
  • The safety, suitability, or quality of any Event or venue;
  • Whether an Organization is properly insured, licensed, or authorized; or
  • The conduct of Organizations, Org Admins, or other Users at Events.

13. Limitation of Liability

13.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, SPORTREG AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BODILY INJURY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF SPORTREG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13.2 Aggregate Liability Cap

In no event shall CourtUp.ca's total aggregate liability to you for all claims arising out of or relating to your use of the Platform exceed the greater of: (a) one hundred Canadian dollars (CAD $100.00); or (b) the total amount of event fees charged to your Membership Balance in the twelve (12) months preceding the event giving rise to the claim.

13.3 Physical Injury Disclaimer

CourtUp.ca is not liable for any personal injury, death, property damage, or other harm sustained by you or any third party in connection with participation in any Event. Physical participation in sports activities is at your sole risk. You are strongly encouraged to obtain appropriate personal health and accident insurance before participating in any Event.

Note for Canadian consumers: Some provincial consumer protection legislation (including the Consumer Protection Act, 2002 of Ontario and similar legislation in other provinces) may afford you rights that cannot be excluded by contract. Nothing in these Terms is intended to limit rights that cannot lawfully be excluded under applicable Canadian law.

14. Indemnification

You agree to indemnify, defend, and hold harmless CourtUp.ca and its officers, directors, employees, agents, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:

  • Your violation of these Terms;
  • Your use of the Platform;
  • Your participation in any Event;
  • Your violation of any applicable law or regulation;
  • Any Content you submit to the Platform; or
  • Any claim that your Content infringes the rights of any third party.

15. Suspension & Termination

15.1 Termination by You

You may deactivate your Account at any time by contacting us at su****t@c******.ca. Prior to deactivation, you should resign from any Organizations for which you are the sole Admin. Deactivation does not automatically cancel pending Event registrations; you must cancel those registrations separately before deactivating your Account.

15.2 Termination or Suspension by CourtUp.ca

CourtUp.ca may, at its sole discretion and without prior notice, suspend or terminate your Account and access to the Platform if:

  • You breach any provision of these Terms;
  • We reasonably suspect fraudulent, abusive, or illegal activity;
  • We receive a valid legal order requiring us to do so; or
  • We decide to discontinue the Platform or any part thereof.
15.3 Effect of Termination

Upon termination of your Account, your right to access the Platform ceases immediately. CourtUp.ca may retain certain data as required by law or for legitimate business purposes. Provisions of these Terms that by their nature should survive termination (including Sections 7, 11, 12, 13, 14, and 16) shall survive.

16. Governing Law & Dispute Resolution

16.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of law principles. You and CourtUp.ca each irrevocably consent to the exclusive jurisdiction of the courts of Ontario for any disputes arising out of or relating to these Terms or your use of the Platform.

16.2 Informal Resolution

Before initiating formal legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at le**l@c******.ca. We will attempt to resolve the dispute within thirty (30) days of receiving written notice.

16.3 Class Action Waiver

To the extent permitted by applicable Canadian law, you agree to resolve disputes with CourtUp.ca on an individual basis and waive any right to participate in a class action or representative proceeding. If this waiver is found to be unenforceable, the class action shall be severed and proceed in a court of competent jurisdiction.

17. Changes to These Terms

CourtUp.ca reserves the right to modify these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of this page and, where required by applicable law, notify you by email to the address associated with your Account or by posting a prominent notice on the Platform.

Your continued use of the Platform after the updated Terms have been posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must cease using the Platform and may request Account deactivation as described in Section 15.1.

We encourage you to review these Terms periodically. The most current version will always be available at courtup.ca/terms.

Your acceptance

By using CourtUp.ca, you confirm that you have read, understood, and agree to be bound by these Terms of Service in their entirety. These Terms, together with our Privacy Policy, constitute the entire agreement between you and CourtUp.ca with respect to the Platform and supersede all prior agreements or understandings relating to the same subject matter.
